'Chasing The Cyclone's Peter Thomas Senese and The I CARE Foundation Has Helped Protect Dozens Of Targeted Children

I am pleased to share my deeply inspired novel Chasing The Cyclone continues to have a significant impact on a large and growing number of children and targeted parents of international abduction.  In fact, the natural progress of events beginning from the initial e-book publication of Chasing The Cyclone led to the creation of the not-for profit I CARE Foundation I am the Founding Director of.  I am happy to share that through the efforts of the I CARE Foundation dozens of children who have either been internationally kidnapped or who have been targeted for international abduction have either been safely reunited with their families or were actually protected from abduction, and remain safely home.

This is a fairly significant statement when considering that the foundation's volunteer reunification efforts represents a  sizeable percentage of all American children coming home (our efforts to reuntie children kidnapped to America are also noteworthy). 

With 100,000 to 125,000 American children and nearly 20,000 Canadian children expected to be internationally kidnapped over the next 10 years, the success of Chasing The Cyclone and the I CARE Foundation is tempered by the reality that there is a long way to go. This notion is underscored by the reality that only 10% of all internationally kidnapped children come home. Think about it for a moment: three professional baseball stadiums filled with defenseless children - all disappearing.  The majority of children will never come home. Some simply can't: they are gone forever.

And this sentiment is not a piece of fiction: it is reality.  And it sucks. And it is worth standing up and fighting for.

I think for any author, the biggest goal when writing any book is to have an impact on your intended audience.  The financial success of a book is obviously important; however, the desire to influence others is the real desire.

And with dozens of children either rescued or protected from abduction thus far, combined with the many initiatives the I CARE Foundation has under way that will further help others, I am pleased with Chasing The Cyclone's impact thus far.

Having seen first-hand the horrors of abduction, I am committed to continuing fighting this fight.  Fortunately, governments from around the world are taking notice of the I CARE Foundation's work - which means we're making a difference. 

In fact, it was a tremendous honor and humbling experience to receive this majestic American Flag flown over the United States Capitol Building at the request of the Senate in appreciation for my volunteer work and support of the I CARE Foundation.

Additionally, last month I had the opportunity to participate in the United State's Department of State's 'International Visitor Leadership Program' at the United State's Mission to the United Nations concerning the foundation's advanced work in child abduction and human trafficking prevention.  It was a great honor, particularly when considering some of the incredible global leaders who have previously participated in the program. 

Unquestionably, the publication of 'Chasing The Cyclone' has helped many parents and children new laws have been passed, new policies implemented, and new legislation that could help stop abduction and trafficking is on the horizon - and children are home. 

My financial commitment to the I CARE Foundation and support of the organization's efforts to help children remains steadfast as shared by I CARE Board Member, Hague Convention Attorney Network member and highly respect attorney Joel Walter in a very kind article he shared on his website. In fact, I have donated 100% of all of my various novel's proceeds over the past year to the I CARE Foundation: it is a commitment I intend to continue.
 
Being able to assist the I CARE Foundation has been a responsibility of mine that in truth has been a privilege to uphold.   But truth is, nearly seven years ago I never even knew the collective words international parental child abduction were.  Nor did I realize that I was one of a surging number of individuals who were not familiar with this vonocular.  And quite frankly, at that time, most individuals in society did not realize the severity of this crime or what a chasing parent will go through to safely bring home their child.  Nor did they realize that sociopathic tendancies of an abusive abductor, who, not only would kidnap a child, but would attempt to slander and defame the targted other parent because international law has established a loophole known as the 'Abductors Defense' (Hague Convention: Article 13) that know targeted parent is immune from.

Who knew that during the time I was Chasing The Cyclone, the promise I made to the God I worship would lead to my volunteer advocacy for children, with the result being the I CARE Foundation and all that the organization has achieved.                                     


THE I CARE FOUNDATION
From the seed that is Chasing The Cyclone, this is a sampling of the things that have been accomplished:
                                                                 

1. The creation of the 501-C-3 Not-for-profit ‘International Child Abduction Research & Enlightenment’ Foundation' (I CARE Foundation
)  that was established to and has successfully rescued numerous internationally kidnapped children while conducting advanced research in the area of IPCA in order advocate for the creation of new laws that will protect children from international kidnapping.

2. Under the I CARE Foundation’s leadership, we have built a large national pro bono network of lawyers willing to assist parents who are targeted to have a child internationally kidnapped or who have had a child abducted while also launching a successful and ongoing recruitment campaign for lawyers to join the United States Department of State's Hague Convention Attorney Network; and,

3. Overseeing the legal rescue and reunification of numerous internationally kidnapped children; and,

4. Provided necessary resources required for numerous lawyers and targeted parents who were trying to prevent their child from being internationally abducted (see 'Senese Creates Arsenal Of Tools To Help Lawyers and Targeted Parents'); and,

5. Board Member Carolyn Vlk wrote the legislation for the State of Florida's Child Abduction Prevention Act while Board Member Peter Thomas Senese orchestrated lobbying efforts that led to the unanimous passage of the CAPA legislation into now effective law; and,

6. Successfully advocated for the federal implementation of the 'Prevent Departure Program' to be used as a tool to stop international parental child abduction; and,

7. Writer and advocate behind legislative initiatives to prevent international child abduction by modifying the Western Hemisphere Travel Initiative; and,

8. Writer and advocate behind legislative initiatives to prevent international child abduction by modifying the Prevent Departure Program II; and,

9. The co-authoring and creation and FREE publication of the extensive 'The World Turned Upside Down' open-tablet E-book resource guide on IPCA; and,

10. The creation and production of the FREE ongoing educations documentary film on IPCA titled 'Chasing Parents: Racing Into the Storms of IPCA; and,

11. The co-authoring of the extensive research report titled 'Crisis In America: IPCAToday'; and,

12. The co-authoring of the extensive research report titled 'International Child Abduction and Human Trafficking In The Western Hemisphere'; and,

13. The creation of one of the most informative websites on IPCA; and,

14. The ongoing efforts to create additional federal laws that evolve around child abduction prevention.

15. The stout support and advocacy that led to the passage of on line impersonation laws such as those passed in the states of California and New York.

16. I have used significant book publication revenue to finance the recovery of internationally kidnapped children.

17. Upcoming I CARE Foundation sponsored educational legal training seminars for lawyers in the area of IPCA.

18.  A large and growing grass-roots effort to educate parents about the risks ofIPCA and child trafficking.

19.  A promise to continue my efforts to educate society about the issues of IPCA, use my resources whenever possible to assist others, and to work toward the passage of new laws that will protect children, as demonstrated in the sworn testimonials of my conduct.

20.  Recently participated in the U.S. Department of State's United State's Mission's International Global Visitor Leadership Program at the Untied Nations

All from a book called 'Chasing The Cyclone' that was inspired by the time in my life I was required to chase into the storms of abduction.

One final note, and this is personally extremely important to me to share.  Before I raised my voice and tried to make a difference in the fight against IPCA, there were, as there are today other wonderful advocates who have fought so hard to protect children by raising their voice, using their resources to fight a good fight, and to pass new laws that will protect children.  I recognize and applaud each of these individuals who make up the community of child advocates who are dedicated to protecting children.

Discussing Peter Thomas Senese's THE DEN OF THE ASSASSIN

1. 'The Den Of The Assassin' is a real-world story of the geopolitical realities society faces today. You accurately cover with reader-friendly acumen very complex topics including the global financial
markets, global political and military instabilities, modern-day biological, chemical, and cyber-warfare, and issues evolving around global-citizenship and communication. How much research was dedicated into creating 'The Den Of The Assassin'?


Writing primarily in historical fiction requires a writer such as myself the need to pay great attention to the presentation of substantial fact in the context of the story being crafted. 'The Den of the Assassin', similar to each of my historical fiction novels, is steep in heavy research. I spend a great deal of time studying various subject matter to the point that I become confident I can take a heavily complex issue and present it in a highly technical, easy to understand, and entertaining manner without losing the complexity of the issues being presented.

Conducting the type of research required for one of my novels takes time, particularly since the multiple issues I address and write about are complex and sometimes the necessary information I am seeking is not so easily accessible.

Combining the fact that my stories always have multiple intriguing plot-lines weaving throughout the fiber of the characters' movements and that my reader-audience typically is highly educated, sophisticated, and quite knowledgeable it is critical that I present accurate, current, and meaningful information - foundations, if you will - in order to create the necessary platforms for my characters' to stand on. In 'The Den of the Assassin', I spent a substantial amount of time researching the complex and fascinating issues that are presented; however, I was also able to draw upon my own deep knowledge base and understanding.


2. Wall Street appears to be a central theme for many of your writings. Why is this?
I view Wall Street as the cradle of America, and one of the most fascinating places in the entire world. Many individuals do not realize just how important a role Wall Street had during the birth of our nation. For example, Federal Hall, which is directly across from the still-mighty New York Stock Exchange, was our great nation's first capitol and the location were General George Washington was inaugurated as America's first president. It is the location where the United States 'Bill of Rights' was first presented to Congress - and a place of many fascinating national and local political secrets! And of course, it is, and should remain the symbolic center of capitalism.

Whenever I put my foot on the 'Street', I feel the raw energy and determination that was instilled from our nation's Founding Fathers. Today, I see this attitude in many individuals who work in the financial markets, and equally viewed, that very same determination that makes a New Yorker a New Yorker. With its deep national and local New York history, Wall Street is in itself a living, breathing character that is hard to replicate anywhere, so it is only natural for me to include in my writing a place that is so unique, historic, current, and personally attached to me.


3. In 'The Den Of The Assassin' America and the free-world face very real and possibly cataclysmic possibilities at the hands of individuals hell-bent on destroying our way of life. How real are the threats of a biological, chemical, or cyber-attack on our nation's soil?

Very real. Modern warfare has changed dramatically with each passing year. And as scientists continue to place great energy and resources into the science of genetic engineering, our reality is that the capacity for a biological attack has made giant strides toward becoming a serious reality. Chemical warfare, and all of its evil possibilities will also continue to increase. However, what appears to be most concerning is the rapidly expanding threats of cyber-warfare. Countries such as China, North Korea, and Russia have extensive, well-trained cyber-warfare military divisions working endlessly to create and develop deployment systems capable of delivering malicious software code and viruses capable of attacking and shutting down a computer network system. Juxtaposing the concern associated with the ever-expanding ability of each of these and other nations' abilities to engage in a new type of potentially crippling warfare - cyber-warfare - and attack our nation's electronic infrastructure is the fact that as a nation, the United States has become reliant on foreign citizens living abroad to fulfill a variety of computer-design and software needs. So in reality we have, in a certain sense, given away the keys to our nation's central nervous system.

For example, one of the more commonly accepted cyber-warfare strategies involves the use of 'Botnets'. Botnets or 'Bot Networks' are made up of vast numbers of compromised computers that have been infected with malicious code, and can be remotely-controlled through commands sent via the Internet. Hundreds or thousands of these infected computers can operate in concert to distribute spam, viruses, or other malicious code. Because Botnet attacks are decentralized and do not typically have a cyber-warfare command center it is near impossible to defend against, while also having the capacity to easily go viral - and spread from one computer network to another at any given time. Imagine if a Botnet is initiated on a worldwide social network such as Facebook.

With hundreds of millions of users capable of downloading a malicious virus capable of shutting down or destroying for example our electric power grid or our telecommunication lines or our banking system, which is not unrealistic, any nation facing this type of threat would have extraordinary challenges on their hands.


4. What risks are associated with our nation's reliance upon foreign countries and their citizens to design and build many of the computer operating systems and software that we use today?

The risks are very straight-forward: we have given the keys to our nation's nervous system - our electronic arteries - without carefully vetting who in fact we have given the keys to. For example, how do we really know who a company located in Eastern Europe that is designing an online video game for a U.S. based company has actually hired to complete software that will be utilized in the United States? We don't. Nor do we know if and what dormant malicious viruses they have installed. This is a very serious problem, and one that will manifest itself as individuals become more connected via the Internet.


5. Russia?

An extraordinarily dangerous country no matter what title Putin gives himself within the pseudo-democracy he controls. Combining the former KGB officers monger-like mentality with the facts that prior to 1991 the Soviet's Bioprepreat had an anticipated 200,000 scientist working in their illegal biological and chemical warfare division - a unit that surely has not disappeared in the wake of genetic advancement, Russia's extraordinary oil reserves, and similar to China, a great desire to remove the U.S. currency as the world's primary currency ... Russia has as it has in the past, its own agenda, and that agenda typically does not line up with the intended policies of the United States.


6. The Arab Spring?

It was one of the most spectacular uprisings by an oppressed people at any given time in history. Clearly, the remarkable use of the Internet to educate, communicate, and mobilize others in the name of freedom and liberty accomplished what outside governments spent incredible resources unsuccessfully doing: planting sustainable seeds of democracy. I think we're only seeing the beginning of true reform in the Middle East and I anticipate that democracy and freedom's light will shine through the oppressive darkness created by dictators.


7. North Korea?
 
North Korea remains a serious problem in part due to its close relationship to China, a psychopathic ruler who has propped himself to be viewed as a God by the country's citizens, substantial warfare capability coupled with its close proximity to South Korea. In its delicate balance, the world's leading countries continue to be in a quagmire on how to deal with North Korea. Though China has come out on occasion condemning North Korea's actions or policies, in my view, Beijing's still very deeply connected to North Korea and the rest of the world knows it. Economic sanctions utilized to protest that country’s various policies have not truly worked because at the end of the day, the troll has such complete power over the nation's citizens that those who suffer most are the nation's neediest citizens.

And this gives the troll even more power because he is able to point to the west and say to his loyal followers that their nation's difficulties are due to the policies of foreign governments intent to take over North Korea.

Which has lead to that country developing a very dangerous arsenal of tactical weapon capabilities - including the creation of a cyber-warfare division that has been in existence for nearly 25 years - when they created the 'Kim II Political Military University', which is also known as the 'secret college' that enrolls over 100 world-class computer hackers, who after graduation, are assigned to the 'General Bureau of Reconnaissance of the Ministry of the People's Armed Forces'.

And with South Korea its neighbor, any type of military conflict with North Korea will cause massive loss of life - so in a certain sense, and due to China's protective eye, the world can do very little other than hope that perhaps we see something similar to the Arab Spring.


8. China?

China is deeply connected to the world economy, which is a safeguard against modern warfare. However, in my opinion two of China's primary political and economic agendas to which they appear to be hell-bent on achieving include removing the U.S. dollar as the world currency standard, and, they're continued investment and creation of infrastructure into Africa. Their activity in Africa, though extremely helpful for many African nations, appears to be taking place in order to mobilize the nation-states of Africa for China's own purposes. Previously, these nations initially became highly instable after the Cold War presumably ended. Combining these goals with China's extreme military build-up - for example their creation of anti-aircraft carrier missiles possibly capable of taking out a nuclear-powered aircraft is in fact changing the way the United States military and in particular our navy prepares for future combat. And China has formed the ‘Blue Army': a very unique team of cyber-warfare computer experts that makes the North Korean's 'Kim II Political Military University' look like a Montessori school for young children. We're talking about a very serious threat, though the size and capability of the Blue Army is not fully understood. What we do know is that they do exist and that they have tremendous resources at their disposal so they may implement their project goals and expand their capabilities.


9. In 'The Den Of The Assassin', the story's protagonist is a Wall Street banker who unexpectedly gets caught in the cross-hairs of a psychopathic former Soviet Union war monger's sight and evil intent to cause grave destruction against America and the free world. Why did you choose to use a banker as the story's protagonist?
 There are many reasons why Tyler Boxter's profession is that of an investment banker. First, the complex story that is 'The Den Of The Assassin' has a very realistic and fungible set of scenarios that require the insight and expertise of a Wall Street insider. And as much as this story takes place on capitalism's Wall Street, the little-often spoken political side of Wall Street was a critical symbol that underscored the antagonist's intent: to destroy all things American and our way of living, including our grasp on liberty and capitalism. And in my mind, Wall Street was America's cradle for both our democratic and capitalistic way of life. So inevitably the story's protagonist needed to be a part of the street - and so Tyler Boxter - the most unsuspecting of individuals soon realizes that the Wall Street he knows is 'The Den Of The Assassin'.


10. How vulnerable are our financial markets to a cyber-attack and how would other nations, including Russia or China benefit if our national grid and computer infrastructure were compromised?

I think any country which had a partial or complete shutdown due to an unspoken declaration of cyber-war would have serious and long-ranging difficulties. Our nation's various national defense agencies spend enormous resources and place mind-boggling effort into ensuring that we detect and isolate cyber-attacks before they spread and cause great damage to our way of living. These individuals are truly our nation's unseen, unspoken, and undetected heroes. And their important role in our nation's homeland defense continues to grow. As for other nations and their potential benefits of having our economy under attack, I think the one nation that would benefit most from this is China, particularly since China desires to remove the U.S. Dollar from the world stage.


11.You romance Wall Street's political history. Can you provide some insight about your love affair with the physical and metaphorical 'Wall Street'?

Before Wall Street was the world's financial market epicenter, it was the nation's first capitol. One of the most important words ever spoken by our nation's first president, the remarkable hero President George Washington, was that 'liberty was an experiment entrusted to the American people'. Those words were said by Washington the night of his inauguration, on April 30th, 1789. Over the years we have witnessed how liberty and freedom changed and expanded in our nation from a time when only white land owners had the right to vote to where we are today ... and our role in spreading liberty throughout the world. And that - liberty - is what Wall Street is about, and it is a romantic, enticing, and most beautiful of concepts and ideals.


12. New York City is clearly a character in its own right in 'The Den Of The Assassin'. Can you provide us with some insight on your New York City?

I think I can speak endlessly about New York City in the most positive of positive ways. I consider myself a New Yorker no matter where in the world I am. I believe New York has its own heart. It is a living, breathing, feeling, and thinking entity unlike any other place in the world. Though not perfect - the New York City I know is one that celebrates our differences, and that, particularly with millions and millions of people living here, is remarkable.


13. Ten words to describe 'The Den Of The Assassin'?

Fast-paced, eye-opening, educational, intriguing, magnetic, accurate, entertaining, current, historical, human.

14. Can you share a personal story about 'The Den Of The Assassin'?

Tragically, during the time of my research dealing with Russia's oligarch system, Paul Klebnikov, the editor of Forbes Magazine Russia was murdered gangland-style in Moscow. Paul died on July 9th, 2004: he was a great journalist and a great family man who was trying to bring to light the massive corruption of the new Russian nation due to the misdeeds of the oligarch system. There were also 21 presidents of banks in and around Moscow alone that were murdered during the time I was researching and writing this story.
15. Did you feel there was a risk associated with releasing 'The Den Of The Assassin'?

 
Yes.
16. What's next for Peter Thomas Senese?

I am busy. In the short-term future I will finally release 'Chasing The Cyclone', while also releasing 'The Den Of The Assassin' in both paperback and multiple-language E-book. 'Cloning Christ' will be released later this year in multiple-languages on E-book, and the sequel to 'The Den Of The Assassin', titled 'Predator's Games' will be released at the end of the year. So from a writing standpoint, I'm busy. I am also involved in some very important volunteer work in the area of child abduction prevention, including the upcoming worldwide release of a research project that I am highly involved with, and, seeking additional abduction prevention laws at a national level. Then there are certain film and television projects that I am substantially involved with that are extremely exciting. But most of all, I'm a father to a really great young son and a partner to an amazing woman - so my life is full, content, and meaningful. It is dramatically different than the times to which I was unexpectedly forced to chase the cyclone!
17. You volunteer a great deal of time supporting literacy programs for kids and are a visible international child abduction prevention activist. Why do you advocate for children's interests the way you do?

Reading and writing changed my life forever in the most positive of ways, so how could I not help support literacy programs or simply take the time on occasion and help a child understand the wonderment of reading - that's one of my favorite things to do - to spend time with one or a few children - and get into their heads - because somehow, I connect with them - and they eventually get it – they understand that reading is the key to everything in life. And as for my work in international child abduction prevention - well, read 'Chasing The Cyclone'.

New York State legislators are on the cusp of passing a remarkable and much needed law that will benefit all citizens of the state: the 'Digital Impersonation Prevention Act'. The Legislation was created to prevent individuals with malice and illicit intent to use the name of another person online for purposes of causing their target personal injury.

New York State Assembly Member Micah Z. Kellner (D-Upper East Side, Yorkville) who has sponsored the crucial legislation in the State Assembly said, "“It seems like every day we hear about a new and horrific case of identity theft. It’s grown beyond hacking into your bank account. People’s lives can be ruined by thieves who steal their email accounts or Facebook pages to use them for malicious purposes. People have actually been driven to suicide in cases.”

One of the benefits of the Internet is that it allows for anonymity; however, there is a serious price to be paid by many because the atmosphere has created the ability for anonymous posters to create false, untrue, slanderous, and harassing content with the sole purpose to cause the person they are attacking undue harm. It has been estimated there were over 9 million victims of online identity theft and impersonation last year alone: a number that is growing.

Presently, in New York State there are various laws that protect online identity theft and impersonation; however, with the anticipated passage of the 'Digital Impersonation Prevention Act', a new specific law will be in place that deals directly with this issue. It can and should be used in conjunction with other laws in place in order to protect those who are targeted for identity theft or impersonation.

One of the ways celebrities may protect their identity is to trademark their name. But this is not possible for the average working person. Copyright protection laws allows for certain protection to occur under laws governing personal property; howver, if you do not have copyrighted work that is attached to you such as a book or a film, then a person will not be protected under law.

In the past online identity impersonation typically involved financial transactions. Today the fastest growing form of online identity theft and impersonation is used to cause personal injury toward a target in conjunction with defamation,slander, libel, and harassing actions including cyberbullying and cyberstalking. Fortunately, in New York State there exists laws that deal with these issue. However, the 'Digital Impersonation Prevention Act' will be a much needed and added resource available to targeted victims.

In the world of international parental child abduction, laws that prevent digital impersonation are critical. For a parent intending to abduct a child internationally, the elements of the abduciton typically include a well thought out plan, including how to defend the abduction if there is a chance that the international courts such as the Hague Courts may become involved. Under the Hague Convention's Article 13, the rules allow for an abducting parent to defend their criminal abduction by claiming that it is in the best interest of the child for the child to not be ordered to return to the country of original jurisdiction. In order to prove this, the criminally abducting parent must 'create' a series of personal attacks on the the target in order to falsely demonstrate the targeted parents incapability to care for the welfare of the abducted child. Commonly, this will include the use of the Internet to slander, defame, harass, and cause grave injury to the target. The majority of this is done anonymously or under false name online via various community forums in order to falsely and misleadingly fabricate a communal negative perspective on the target. And unfortunately for the targeted parent, they have their hands more than full at that time because they are attempting to navigate the cruel multi-international litigation nightmare attached to trying to prevent, find, or bring home their child.

During the time that my child was internationally abducted in accordanc to the rules of the Hague Convention, I, like many parents who came before me as well as those who will sadly come after me, had to deal with this very issue. I was fortunate in the sense that the international courts under the Hague had seen through the conspiracy, and these courts ordered for my child to be returned. I was able to present literally several hundred sworn personal and professional letters to the court referring to my conduct, and I had resources available that allowed me to successfully litigate against the malicious slander and defamation that took place. I am also aware that many targeted parents may not have the resources to accomplish some of what I have. And that is why, from a viewpoint of international parental child abduction, laws such as the 'Digital Inpersonation Prevention Act' must be passed into law in each and every state.

Unfortunately for many targeted parents of abduction who have successfully recovered their child, a problem still exits: the abducting parent still remains at large: bitter, angry, and filled with a desire for revenge and to cause the chasing parent additional harm (it is noted by leading experts in the area of IPCA that the vast majority of parental abductors use the child of the relationship in order to cause great harm toward the targeted parent). In fact, Dr. Janet Johnston (Judith Wallerstein Center for the Family in Transition) and Dr. Linda Girdner (ABA Center on Children and the Law) along with other reknown therapist and law enforcement officers have openly stated that an abducting parent exhibit sociopathic behavior and have little respect for or concern of the law.

Online identity theft and impersonation generated due to malice is a growing and very serious problem. Civil litigation can protect an individual from defamation and slander, but the process can be long. Additionally, if you sue a person due to their misconduct, if they have no assets, you may be able to have the defamatory content removed from the Internet, but the individuals behind the malice will not be held truly accountable for their acts. And in certain circumstances content cannot be taken down under Internet law (though I have recently learned that there are other possible ways to have content removed). Nevertheless, once untruthful content is placed online, there is a challenge to have it removed. One important remedy a targeted person can do is to address matters under criminal law, particularly since many cases of malicious online impersonation include defamatory, slanderous, and malicous content posted. The 'Digital Impersonation Prevention Act' adds to the arsenal of laws already established that may be utilized to protect individuals from online malice.

Various research also indicates that a person who will impersonate or steal another person's online identity is acts with fearless reckless abandonment because they think they are protected to continue their acts because of the difficulties associated with their target bringing litigation, and, under civil court action, they can be sued - but if they have very little to take, they could care less.

The remedy to all of this is very simple: create and enforce criminal codes that will hold individuals who impersonate or steal another person's identity with the sole purpose of causing malicious harm to that person fully and unequivocally accountable under criminal law. I speak from heavy experience on this issue as I have been the victim of this type of act to which I have taken serious and unilateral action under all laws available to me.

“Anonymity is a criminal’s best friend—and it’s one of the defining features of the Internet,” said Assembly Member Kellner. “New Yorkers deserve stronger protections so we can bring these nefarious individuals out of the shadows and hold them accountable for their actions.”


I am in full support of the passage of the Digital Impersonation Prevention Act as this bill will be a great law for New York. I hope you will be as well. Here is the legislation that is moving its way through Albany's legisltion.

TITLE OF BILL:
An act
to amend the penal law, in relation to enacting the digital
impersonation prevention act

PURPOSE OR GENERAL IDEA OF BILL:
To establish the crime of digital
impersonation and to create effective penalties for those who engage
in digital impersonation for the purposes of harming, threatening, or
defrauding another person, sending unsolicited bulk mails or
commercial solicitations, or downloading or utilizing a contact list.

SUMMARY OF SPECIFIC PROVISIONS:
Section 1:

Establishes the title 'Digital Impersonation Prevention Act"

Section.2:

-Amends the penal law by adding a new section 190.87, establishing the
crime of digital impersonation;

-Provides that a person is guilty of digital impersonation when he or
she, knowingly, with intent to defraud and without consent,
creditably impersonates another actual person through or on an
Internet web site or by other electronic means for purposes of: (i)
harming, intimidating, threatening, or defrauding another person;
(ii) transmitting unsolicited commercial solicitations or unsolicited
bulk messages; or (iii) copying, accessing, downloading or utilizing
a contact list;

-Establishes the meaning of creditable impersonation;

-Defines "electronic means," "contact list," "unsolicited commercial
solicitations," and "unsolicited bulk messages";

-Establishes penalties for violations; and

-Provides that a person who suffers loss or damage by reason of a
violation may a bring civil action against the violator; sets forth
damages and other relief.

Section 3: Sets effective date

JUSTIFICATION:
Digital identity theft, more accurately known as
digital impersonation, has been a growing problem in the internet era.
The US Federal Trade Commission estimates that as many as 9 million
Americans have their identities stolen each year. Historically, the

major motive for identity theft has been financial fraud, as thieves
use
stolen identities to make credit card purchases, withdraw funds, and
set up phony accounts. Over the past few years, we have seen an
increase in a more personal kind of impersonation: the use of
Internet anonymity to harass individuals. In 2010, for instance, the
New York Times reported on the rise of cyber bullying and what can
happen if the issue is not addressed. The article told the story of
Marie, a single mother from Newburyport, Massachusetts, whose son had
become increasingly withdrawn since entering a new high school. After
some investigating, Marie discovered that a number of her son's
classmates had created a Facebook page with her son's name and
picture. The page in question was being used by others to bully
people her son barely knew, with the blame for
this behavior falling unfairly on her son. It is clear that stronger
measures are needed to combat such actions.

Additionally, thieves have made use of stolen identities to send
'spam' unsolicited bulk email messages and commercial
solicitations-circumventing mechanisms intended to block such
unwanted messages by sending them from the accounts of unwitting
identity theft victims. According to a report commissioned by McAfee,
a computer-security company, approximately 62 trillion unsolicited
emails were sent in 2008, with serious economic and environmental
consequences. Many of these messages were sent from stolen or
hijacked email accounts.

Already, states like California have passed laws to crack down on
digital impersonation. New York should follow suit. This legislation
would create effective penalties for those who engage in digital
impersonation for the purposes of harming, threatening, or defrauding
another person, sending unsolicited bulk emails or commercial
solicitations, or downloading or utilizing a contact list. It also
establishes a civil cause of action for people who are victims of
digital impersonation.

EFFECTIVE DATE:
The law shall take effect on the first of November
next succeeding the date upon which it shall have become law.

THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM
BLY, DO ENACT AS FOLLOWS:
Section 1. This act shall be known and may be cited as the "digital
impersonation prevention act".
S 2. The penal law is amended by adding a new section 190.87 to read
as follows:
S 190.87 DIGITAL IMPERSONATION.
1. (A) A PERSON IS GUILTY OF DIGITAL IMPERSONATION WHEN HE OR SHE,
KNOWINGLY, WITH INTENT TO DEFRAUD AND WITHOUT CONSENT, CREDIBLY IMPERSO
NATES ANOTHER ACTUAL PERSON THROUGH OR ON AN INTERNET WEB SITE OR BY
OTHER ELECTRONIC MEANS FOR PURPOSES OF: (I) HARMING, INTIMIDATING,
THREATENING OR DEFRAUDING ANOTHER PERSON; (II) TRANSMITTING UNSOLICITED
COMMERCIAL SOLICITATIONS OR UNSOLICITED BULK MESSAGES; OR (III) COPYING,
ACCESSING, DOWNLOADING OR UTILIZING A CONTACT LIST.
(B) FOR PURPOSES OF THIS SECTION, AN IMPERSONATION IS CREDIBLE IF
ANOTHER PERSON WOULD REASONABLY BELIEVE, OR DID REASONABLY BELIEVE, THAT
THE DEFENDANT WAS OR IS THE PERSON WHO WAS IMPERSONATED.
2. FOR PURPOSES OF THIS SECTION: (A) "ELECTRONIC MEANS" SHALL INCLUDE
CREATING OR OPENING AN E-MAIL ACCOUNT OR AN ACCOUNT OR PROFILE ON A
SOCIAL NETWORKING INTERNET WEB SITE IN ANOTHER PERSON'S NAME; OR ACCESS
ING ANOTHER PERSON'S PRE-EXISTING E-MAIL ACCOUNT OR AN ACCOUNT OR
PROFILE ON A SOCIAL NETWORKING INTERNET WEB SITE; OR ALTERING OR CHANG
ING THE PROPERTIES OF AN E-MAIL, OR E-MAIL HEADER, TO APPEAR AS THOUGH
THE E-MAIL ORIGINATED FROM A DIFFERENT SOURCE WITHOUT THE EXPRESS
CONSENT FROM THE ACCOUNT HOLDER.
(B) "CONTACT LIST" SHALL INCLUDE ANY LIST OF THIRD-PARTY CONTACT
NAMES, ADDRESSES, TELEPHONE NUMBERS, MOBILE PHONE NUMBERS, FACSIMILE

OR SERVICES OR TRANSMISSION OF A HYPERLINK TO A WEB SITE OR UNIFORM
RESOURCE LOCATOR (URL) WHICH HAS ANY MATERIAL ADVERTISING THE AVAILABIL
ITY OR QUALITY OF ANY PROPERTY, GOODS, OR SERVICES.
(D) "UNSOLICITED BULK MESSAGES" SHALL INCLUDE THE TRANSMISSION OF AN
E-MAIL, INSTANT MESSAGE, OR SOCIAL NETWORKING POST THAT IS PUBLISHED TO
MORE THAN ONE UNIQUE RECIPIENT.
3. A VIOLATION OF SUBDIVISION ONE OF THIS SECTION SHALL BE PUNISHABLE
BY A FINE NOT TO EXCEED ONE THOUSAND DOLLARS OR BY IMPRISONMENT NOT TO
EXCEED ONE YEAR, OR BY BOTH THE FINE AND IMPRISONMENT.
4. IN ADDITION TO ANY OTHER CIVIL REMEDY AVAILABLE, A PERSON WHO
SUFFERS DAMAGE OR LOSS BY REASON OF A VIOLATION OF SUBDIVISION ONE OF
THIS SECTION MAY BRING A CIVIL ACTION AGAINST THE VIOLATOR FOR STATUTORY
DAMAGES OF FIVE HUNDRED DOLLARS PER OCCURRENCE, COMPENSATORY DAMAGES,
AND INJUNCTIVE RELIEF OR OTHER EQUITABLE RELIEF. IF THE COURT FINDS THAT
THE DEFENDANT WILLFULLY OR KNOWINGLY VIOLATED THIS SECTION OR THE REGU
LATIONS PRESCRIBED UNDER THIS SECTION, THE COURT MAY, IN ITS DISCRETION,
INCREASE THE AMOUNT OF THE AWARD TO AN AMOUNT EQUAL TO NOT MORE THAN
THREE TIMES THE AMOUNT AVAILABLE UNDER THIS SUBDIVISION.
5. FOR PURPOSES OF THIS SECTION, "OCCURRENCE" SHALL INCLUDE EACH ACT
OF CREATING OR OPENING AN E-MAIL ACCOUNT OR AN ACCOUNT OR PROFILE ON A
SOCIAL NETWORKING INTERNET WEB SITE; ACCESSING ANOTHER PERSON'S PRE-EX
ISTING E-MAIL ACCOUNT, ACCOUNT OR PROFILE ON A SOCIAL NETWORKING INTER
NET WEB SITE OR CONTACT LIST; ALTERING OR CHANGING THE PROPERTIES OF AN
E-MAIL, OR E-MAIL HEADER, TO APPEAR AS THOUGH THE E-MAIL ORIGINATED FROM
A DIFFERENT SOURCE; AND THE TRANSMISSION OF AN UNSOLICITED COMMERCIAL
SOLICITATION TO A UNIQUE RECIPIENT.
