Peter Thomas Senese and I CARE Foundation Confirm New Film About International Parental Child Kidnapping

I am very pleased to confirm that I will be producing on behalf of the I CARE Foundation and Pacifica an upcoming feature documentary film 150,000 Internationally Kidnapped Children focuses on the cataclysmic growth of international parental child kidnapping in the United States, Canada and abroad.  The film will dissect why the hideous crimes against innocent children has reached pandemic levels that have claimed so many lives and what can be done to prevent abduction, while also offering solutions that should be implemented that can help current child-victims of cross-border kidnapping.

The film's title 150,000 Internationally Kidnapped Children originates from a widely distributed and cited study titled Crisis In America written by renown child advocate Carolyn Vlk (a member of the Board of Directors of the I CARE Foundation, and a member of the Special Advisory Board of the Amber Watch Foundation) and myself.  150,000 Internationally Kidnapped Children is the average weighted forecast of that takes into consideration how many children living in The United States, Canada, and Mexico are anticipated to actually be internationally parentally kidnapped over the next ten years.

The film will bring viewers into several intriguing parental child abduction cases, through the legal system available to targeted parents and children, the psychological trauma of kidnapping and its affects, and eventually above a microscope looking at the government agencies and their existing policies responsible for protecting children. Paramount to the film's direction is the intent to offer new solutions to a serious social problem that in the United States alone is expected to cost the American economy over Six Billion dollars over the next decade.

150,000 Internationally Kidnapped Children will also focus on how children of both parental and stranger-abductions are easily removed from one nation's border to another under existing policies in North America, and particularly in Europe.

The I CARE Foundation and several of it's Board of Director members have been studying key aspects of international parental child abduction for some time.  150,000 Internationally Kidnapped Children will include substantial data and information based upon these unique and groundbreaking studies. Studies and information, I might add, that I fully expect will change the landscape of abduction prevention. Which is, by virtue, the mission of the I CARE Foundation.

And of course, I am thrilled to once again be working and writing with Carolyn Vlk, who is one of the brightest and most knowledgeable persons concerning abduction that I know.  In the past, Carolyn Vlk and I produced the important educational documentary film series Chasing Parents: Racing Into The Storms of Child Abduction that has come to benefit many targeted parents from around the world, as well as our publication of the most up-to-date resource guide on child abduction prevention and reunification titled The World Turned Upside Down. 

As a storyteller deeply familiar with the world of child abduction, it is my personal hope that this film will not only raise awareness of parental abduction so targeted parents may act to protect their families, but it is my aspiration to also provide keen social insight into the horrors that exist so our lawmakers will move on new laws and policies that will help protect children in a similar manner that we accomplished through passage of Senate Resolution 543, the State of Florida's Child Abduction Prevention Law, the State of New York's and the State of California's criminal Cyber-Impersonation and Cyber-bullying laws, and the implementation of the highly effective abduction prevention tool - the federal Prevent Departure Program by the Department State in conjunction with the Department of Homeland Security.

150,000 Internationally Kidnapped Children  will be released during the late Spring - early Summer, 2013.

Similar to all projects associated with my work as a child advocate and steward raising awareness of child abduction, the 150,000 Internationally Kidnapped Children film is personally financed through charitable donations from my business holdings.

A Planned Christmas Child Abduction - That Is Not Going To Happen

Several weeks ago the I CARE Foundation began an educational campaign reminding parents that the Christmas Holiday Season is International Parental Child Abduction Season.   In an effort to raise awareness, I had written a series of essays that were posted on an assortment of websites.

Our warning to parents to be mindful of the possibility of abduction during this time of year must be taken seriously.

Earlier today, one of the I CARE Foundation's board members was contacted by a parent who shared information with one of our directors concerning the other parent of the child.  What she shared included:

1. A strained relationship that included acts of abuse.

2. A new-found 'love' by the other parent and desire to make the partnership work.

3. A request to travel abroad to that other parent's family, which so happens to be the country of origin and citizenship of the partner.

4. A recent selling of a car for at least $7,500.00; however, no deposit of the sale has occurred in any bank accounts the inquiring parent has access to or is aware of.

5. Discovery of the child's educational transcripts.

6.  Recent shipment of clothing to help out 'the poor'.

7. Late night 'walks' that appear to be time when secretive phone calls are made as indicated by discovery of international pre-paid calling cards.

8. A previous false claim 2 months ago of domestic violence.

After hearing of these events, the I CARE Foundation board member made some suggestions that might give more clarity on whether an international parental child abduction is planned.

Sure enough - the parent followed the instruction provided.  Discovery unquestionably shows abduction during the Holiday is planned.

 . . . It may be planned . . . but it sure is not going to happen.

Parents Dealing With Divorce Should Not Let Their Children Travel Abroad With The Other Parent During The Christmas Holiday Season - International Parental Child Abduction.

The Christmas Holiday Season is also one of the most prominent times of year when many children are internationally abducted by one parent from another. It is critically important that any parent who is in a partnership with an individual who originates from or has family abroad to be highly suspect of the possibility of international parental child abduction during this time of year.

As in all cases of parental abduction, these crimes against children are well-thought-out, well-planned and designed to catch a targeted parent off-guard and unsuspecting that a horrible scheme is underway to have their child taken. 

And the schemes that eventually see children abducted or illegally detained abroad are being carried out right now.

However, if you know the warning signs to look for, parents have a fair chance of protecting their child or children from abduction. 

With 100,000 to 125,000 American Children and anywhere from 12,500 to 20,000 Canadian children reported to be expected to be internationally abducted over the next ten years DO NOT STICK YOUR HEAD IN THE GROUND:  International parental child abduction is a pandemic that silently steals children.  

Don't let your child be abducted.  Educate yourself.

You should know only an estimated 10% of all children internationally abducted ever come home. 

What To Look For

In many instances of cross-border parental child abduction that occurs during the holiday season, generally the largest number of incidents takes place when one parent travels to another country with their child or children of a relationship accompanied by, or with the initial consent of the other parent.  

Generally, the travel takes place under a guise of a holiday trip abroad to visit family members of the parent intending to abduct.  Of course, the targeted parent is clueless as to what is really going on. 

So for example, Father X was born and raised in the Middle East but married Woman Y, who is an American citizen.  The couple lives in the United States, where their child was born and raised. 

Unknown to the the woman in the relationship, the husband wants to end the relationship and relocate back to his country of origin back in the Middle East.  However, he has one problem: he knows that his wife will never allow for him to legally take the child with him.

So instead of announcing his true intent to separate, the husband will create critically important misdirection.  Meaning, he will do everything possible to make his wife believe that he is happy and committed in the relationship.   

I did say everything possible.  

Why? 

Becuase it is critical that she put her guard down and not suspect any foul play or scheme.

In the meantime, little things - that are really big things - may be taking place visibly or without knowledge of the targeted parent.  There are many warning signs to look for, but if the subtleties are not carefully considered, then the would-be abductor will get away with their plan.

So the husband who is intending to abduct the child by wrongfully detaining the child abroad will continue to create a facade of being happily married and committed to the relationship while carefully laying out a plan to get the child abroard.

Eventually, and right about this time of the year, the would-be abductor makes the suggestion that it would be 'great' or 'nice' or 'meaningful' to travel abroad together or without the other parent (depending on reasonable circumstances) in order to see his parents, siblings, and extended family.  And of course, all of this is in the best interest of the child of the partnership. 

Now, since the wife may believe the husband is committed to their relationship and does not even consider that he may have intent to not return to their marital home, she more than likely is willing to consent to the holiday vacation. 

Unfortunately for the mother and child, the trip takes place.  

Unknown to both, the parent intending to abduct has already hatched a well-thought out plan, including what may be necessary to keep the child abroad while removing the other parent's rights to the child abroad. 

Everything is deception - and everything must be considered. 

For example: the husband may ship certain belongings like a crib or a stroller and other items of the child that may create the appearnace the other parent knew he was relocating - and gave consent! Or, he may have begun to move his assets abroad. 

Once abroad with his wife and child, the woudl-be abductor may make false accusations of child or spousal abuse (men and women both claim abuse in cases of of planned abduction), claims of drug use, or any other claim that may indicate that the child is at risk.

By stating the child is at risk, this could potentially allow a local court in the foreign country to grant him immediate custody of the child - even though the child's original jurisdiction is in the country they were born and raised.  In addition, in cases where a Hague Application may be filed, the abductor has laid ground for an Article 13 Defense (which evolves around the best interest of the child). 

If it sounds complicated, it is. 

It is important for individuals married or in a relationship with partners who originate from non-Hague countries such as those located in Asia, Africa, and the Middle East to understand that if you are traveling to nations located in these areas and the other parent intends to not return to the child to the country of original jurisdiction, there is a very good chance they will be successful in keeping the child abroad . . . and your contact will be limited or absolved completely. Additionally, it is important to pay careful attention to Hague-Convention non-complying countries such as Germany, Brazil, Mexico, and Poland. 

Of course, if you ever plan to travel abroad and have been involved in a suspecious or strained relationship, please contact an attorney who is familiar with international parental child abduction prevention.  

Though I am not an attorney, I would highly advise you consider obtaining a court order prior to travel that the child is to be returned.  However, remember - in countries that are not members of internatinal treaties regarding abduction or do not comply to such said treaties - if a child is taken - it will be very costly and difficult to bring your child home. 

So - if you have any suspecion that an abduction might be planned - and this time of year is the planning period for the high number of Christmas Holiday Abductions that occur - seek the advice of a qualified lawyer - and do not let your child travel abroad under any circumstance.  Pay attention to the warning signs and act now!

As many know, I am committed to not only raising awareness about child abduction, but through the I CARE Foundation I am the Founding Director of, I am absolutely committed to stopping abduction by creating new laws and policiies that help prevent abduction or reunite children  who have been abducted.  And whenever possible, the I CARE Foundation will do what is necessary to help safely and legally bring a child home - something we have accomplished on numerous occassions thus far this year. 

I am pleased to share my deeply inspired novel Chasing The Cyclone continues to have a significant impact on a large and growing number of children and targeted parents of international abduction.  

In fact, the natural progress of events beginning from the initial e-book publication of Chasing The Cyclone led to the creation of the not-for profit I CARE Foundation.  I am happy to share that through the efforts of the I CARE Foundation dozens of children who have either been internationally kidnapped or who have been targeted for international abduction have either been safely reunited with their families or were actually protected from abduction, and remain safely home.

This is a fairly significant statement when considering that the foundation's volunteer reunification efforts represents a  noteworthy number of all American children who have come home.  Truth is, the majority of children will never come home. Some simply can't: they are gone forever.

And this sentiment is not a piece of fiction: it is reality.  And it sucks. And it is worth standing up and fighting for.

I think for any author, the biggest goal when writing any book is to have an impact on your intended audience.  The financial success of a book is obviously important; however, the desire to influence others is the real intent.

And with dozens of children either rescued or protected from abduction thus far, combined with the many initiatives the I CARE Foundation has under way that will further help others, I am pleased with Chasing The Cyclone's impact thus far. But there is a long way to go.

Having seen first-hand the horrors of abduction, I am committed to continuing fighting this fight. Fortunately, governments from around the world are taking notice of the I CARE Foundation's work - which means we're making a difference. 

In fact, last month I had the opportunity to participate in the United State's Department of State's 'International Visitor Leadership Program' at the United State's Mission to the United Nations concerning the foundation's advanced work in child abduction and human trafficking prevention.  It was a great honor, particularly when considering some of the incredible global leaders who have previously participated in the program. 

Unquestionably, the publication of 'Chasing The Cyclone' has helped many parents and children:  new laws have been passed, new policies implemented, and new legislation that could help stop abduction and trafficking is on the horizon - and children are home.

My financial commitment to the I CARE Foundation and support of the organization's efforts to help children remains steadfast as shared by I CARE Board Member, Hague Convention Attorney Network member and highly respect attorney Joel Walter in a very kind article he shared on his website. Highly Decorated New York Police Officer Has Daughter Internationaly Abducted

A highly decorated active-duty New York police officer who, prior to becoming a law enforcement officer, was a member of the Fire Department of New York, and is desperately fighting for the safety of his internationally abducted child, who was illegally detained in Germany in 2009.

For the general public not familiar with the bizarre world of international parental child abduction - an absolute crime under federal law categorized as kidnapping, the circumstances of this father's (herein referred to as CM) ordeal sheds further spotlight on the horrors children and targeted parents face when dealing with child abduction.

Think about this:  CM is a highly decorated model citizen.  He has served his city, state, and country.  He is well-liked.  He has never done anything that will even come close to an act of abuse toward another.  He is the type of man you would want your son to grow up to be like.

And he has dedicated his life to upholding laws so that innocence can be protected.

Sadly, for CM, the laws that he upholds are not the same laws that have been used to protect him or his daughter.  And today, his young daughter who is nearing four years old, is potentially in a very dangerous place.


CM's ordeal highlights the tragedy that all parents of abduction face: laws that are not upheld, criminal acts of kidnapping that are not prosecuted, acts of contempt and perjury that are never punished, financial depletion of monies spent as a crime-victim that are never replaced, years of living like a ghost- living in purgatory while you wait in hope that you will reunite with your child - that are never replaced, pleadings with our government leaders to assist protect your kidnapped child only to have your phone calls or emails never returned, and frustration over a system that you believed in that never believed back in you to the point that you question everything.  But perhaps the most difficult part of it is the day-in day-out living in fear that something bad may have occurred to your child, and you can't do anything about it.

And bad does happen.  Outside of the severe forms of being kidnapped, which is child abuse, many abducting parents bombard the stolen child with egregious acts of parental alienation and isolation tactics in order to have the child literally sanction that parents 'taking' act.  The outcome?  The innocent child is brainwashed into thinking that the other parent is a bad person trying to hurt their present care giving parent as well as them.

But that road is much more dangerous for a child than the abuse mustered by the stealing parent.  Remember, the abductor is a fugitive.  And fugitives take unnecessary risks that put a child in jeopardy.

In the case of CM, the outlandish acts that have occurred for him and a child are so severe that it is unthinkable.  Even as I write this, I am shaking my head knowing of the horrific ordeal that has gone on.

How bad has it been?

Well, to begin, CM's former wife, who comes from a small village in what was formerly East Germany where the average income is very low, traveled with CM and their infant daughter to visit her parents.  Prior to the trip from New York, CM shipped some belongings as the couple was planning on staying in Germany for several weeks.  One of the items was a stroller.  After two weeks, CM had to return back to New York for work, while his wife and daughter were going to remain in Germany for two more weeks before coming home.  Unfortunately, that was not the plans of his wife, who had been married to CM for less than two years.

What was her plan?

To say in Germany, file false claim after false claim against CM, and in the midst of illegally detaining his daughter, seek child support and alimony in Germany and in the United States, while also seeking a large share of the material assets.

In another words, she had a winning lottery ticket, and she knew it.

Eventually, CM filed a Hague Application due to the wrongful detention of his daughter.

Now for those of you who do not know about international law, the Hague Convention is a legal treaty the U.S. and Germany are parties of that attempts to remedy international abduction cases because it attempts to determine which country has final jurisdiction of an abducted child.  However, as many chasing parents and lawyers will testify to, the courts are not objective, and subjectivity is the common rule of law that takes place.  Which leads to signatory countries being considered non-complying nations.

And Germany has consistently been considered a non-complying nation to the Hague Convention.

How bad?

Consider this: in the case of CM, the New York resident and 9-11 hero was told very matter-of-fact that if he did not consent to allowing his daughter to remain in Germany, the courts would order that he would never see her again!

Seriously?

Now you might be asking yourself how in the world could that be done?

The answer is pretty simple:  many countries who are members of the Hague Convention do not uphold the spirit or intent of the law.  In the case of CM, his daughter was born and resided in New York City. He never consented to a relocation.  He was a custodial parent.

Despite all this, the German courts strong-armed him and attempted for him to disregard the Hague Convention, and in fact, there was little the United States government could do.

How bad has it gotten?  When CM had a recent trial, his lawyers, which included a member of the I CARE Foundation's board, intended to call upon several high-ranking senior law enforcement officers who were prepared to provide key testimony on this case.  However, what did this judge do?  He not only denied counsel's right to call on the three witnesses, but limited it to one witness, and then said directly to CM, "I hate cops.  All cops are liars."

Imagine that.  CM, who has been an exemplary citizen, friend, parent, and son had his rights whisked away by a buffoon judge in a nano-second.

But things have gotten worse for CM.  In Germany, he has had an appeal filed for over 16 months in his attempt to reunite with his abducted daughter.  For 16 months, the German courts have not put the case on any calender despite the rules of international law calling for a swift remedy.

Worse, there have been independent reports filed by German officials that the child's safety may be at serious risk due to inappropriate activity that would make any adult cringe.

So what did CM do?  Nearly 2 months ago, he contacted the Department of State's Office of Children's Issues and requested an emergency welfare check for his daughter.

Well, wouldn't you know it: upon the Department of State making contact with the abducting parent, she informs the US official that she is going on a retreat into the forest for 3 weeks, and there is no Internet or cell phone service.  CM's urgent welfare check turns into a tree-hugging expedition for the kidnapper, who once again turns away justice.

Despite this, CM continues to plea for the Department of State's assistance in finding out the welfare of his daughter in lieu of ugly reports filed in the German courts about conduct taking place in the residency of where his daughter was being detained.

Despite these requests, nothing is done, and in fact limited communication has taken place.

So we decided to do something about it.  We went to Washington, D.C. and visited senior lawmakers and their aides in hope that the Department of State and our Congress will intervene, and in the very least for the moment, ensure that CM's daughter is physically safe, and a parent's worst nightmares for his daughter are not a reality.

Imagine being the person known as CM: racing into burning buildings to protect lives, standing in harms way of gun-totting drug dealers in order to protect innocence, and having a beautiful three-year old girl who is potentially at grave risk of serious injury, and there is nothing you can do and nothing your government is willing to do to assist you and your American-citizen daughter.

I CARE Foundation Urges Lawyers In Texas, Nevada, Arizona & New Mexico Sought To Join Department of State's "Attorney Network"

The International Child Abduction Research & Education Foundation (I CARE Foundation) has launched a recruitment campaign urging attorneys located in Texas, Arizona, New Mexico and Nevada to join the United States Department of State's Hague Convention Attorney Network ("Attorney Network") - and help protect innocent children victimized or targeted by international parental child abduction (IPCA). Texas, Arizona, New Mexico and Nevada are hotbeds for IPCA due to a significant increase in reported and unreported parental kidnapping cases to and from Mexico and remaining Central America. The Department Of State's recruitment of attorneys in these states is due to the rise in abduction cases, combined with their effort to educate undocumented parents living in the United States who have been victimized by child abduction that they and their abducted children have protective rights under the Hague Convention.

The I CARE Foundation is urging lawyers in Texas, Arizona, New Mexico, and Nevada interested in assisting parents of children who have been internationally abducted or who may be targets of international parental abduction to participate in the Department of State's "Hague Convention Attorney Network" according to Peter Thomas Senese, a director of the foundation. "In order to prevent child abduction, the reality is lawyers educated on the complex issues of international child abduction need to be mobilized within the Department of State's attorney network. When this occurs, there will be significant opportunity to educate a less than knowledgeable judiciary who are too often unfamiliar with the complexities typically present in these cases. Additionally, and of equal importance, particularly in Texas, Arizona, New Mexico and Nevada is the need for undocumented individuals living in the United States to know that if their child is abducted from the United States, they have major recourse under the Hague Convention, and that the Department of State's Office of Childrens Issues is ready, willing, and able to assist them.

The Office of Children's Issues in the U.S. Department of State serves as the U.S. Central Authority for the Hague Convention on the Civil Aspects of International Child Abduction (the "Convention"). The International Child Abduction Remedies Act ("ICARA"), establishes procedures for litigating Convention cases in the U.S. The U.S. Central Authority has numerous functions including facilitating the institution of judicial proceedings in the U.S. "with a view to obtaining the return of the child and, in a proper case, to make arrangements for organizing or securing the effective exercise of rights of access." In April of 2008, the U.S.Central Authority assumed the responsibility for all incoming cases, and overseeing a network of volunteer attorneys.

The "Attorney Network" provides critical assistance. Lawyers that join the "Attorney Network" are asked to consider taking Hague Convention return and access cases on a pro bono or reduced fee basis. There is never an obligation to take a case, and legal fees and expenses may be recoverable under the Convention's Article 26 and the implementing statute (42.U.S.C 11607), and under state law when state law remedies are pursued (e.g., UCCJEA). In addition, lawyers with and without Hague experience are welcome to join the Attorney Network, as the Attorney Network offers a host of information and mentor programs. In addition to incoming cases of abduction, attorneys can also represent parents in abduction prevention cases and outgoing abduction cases.

Presently, there are over 1,640 'reported' cases of IPCA originating from the United States according to the last published report issued from the Department of State to Congress. The number of cases has nearly tripled from 2006 to 2009 alone according to a recent report issued by the Government Accountability Office's ("GAO"). According to I CARE, the number of 'unreported cases' of IPCA appears to be substantial and at least equal the number and growth rate of 'reported' cases.. Many of the 'unreported' cases appear to involve immigrants who originate from Central and South American, and Texas, New Mexico, Arizona, and Nevada (along with California) clearly have a high-volume of incoming and outgoing cases.

Peter Thomas Senese added, "Overall growth rate of IPCA is conservatively estimated to be between 15% - 20% per year, and there could be well over 100,000 children abducted from the United States between 2009 and 2020 if current trends conservatively stay the same."

As the growing rate of abduction and the shortage of trained attorneys becomes more well known, key media voices in the legal community have recently come to support I CARE's recruitment campaign for attorneys to join the Department of State's "Attorney Program." Aware of the growing crisis in Connecticut, the Connecticut Law Tribune(CLT) recently published an important article concerning this issue.

Patricia M. Lee, a Florida attorney practicing in the area of parental child abduction and a Director of the I CARE Foundation who was interviewed by the CLT states, “I feel privileged to have been a referral attorney for the implementing agency for many years of my private practice. The trauma experienced by victimized children and parents when faced with a child abduction, especially in the international arena, is overwhelming, primarily due to the lack of experienced attorneys, but also, due to the great financial burden, and cultural and language barriers. When they have nowhere else to turn and are so desperate, being able to help these people has been a rewarding experience personally, as well as professionally. It is worth every hour I have spent climbing the learning curve in this little known area of the law. OCI has always been responsive and helpful in the practicalities of dealing with clients living abroad, and the network of mentor attorneys available across the U.S., nothing short of a wealth of information and assistance. My experience in taking these cases has been humbling, to say the least, as I have seen the very best of my profession, which is too often the object of jokes and derision.
